1. Agreement
These Terms of Service are between you and IndicWave LLC("we", "us", "our"), the operator of Viara. By creating a Viara account or using the Viara app, you agree to these terms. If you don't agree, please don't use Viara.
2. Who can use Viara
You must be at least 18 years old and able to form a legally binding contract to create a Viara account. Profiles for children or other dependents may only be created and managed by their parent or legal guardian, using the guardian's own account, and dependents are not account holders.
3. Your responsibilities
You're responsible for the accuracy of the information you enter, including medical information about people in your care. Viara does not verify it. You're responsible for keeping your login credentials secure and for the actions of anyone you invite into your family's care circle. Don't use Viara to store information about someone who hasn't authorized you to manage their care, except where you are their parent or legal guardian.
4. Medical disclaimer
Viara helps you organize and share health-related information. It is not a medical device, does not diagnose or treat any condition, and nothing in the app is medical advice. Always consult a qualified healthcare provider for medical decisions, and call emergency services directly in an emergency. Do not rely on Viara as your primary means of getting emergency help.
5. Subscriptions
Viara's plan tiers are shown in-app under Settings → Your Plan. Any paid plan, if and when available for purchase, will state its price and billing terms at the point of purchase before you're charged.
6. Acceptable use
Don't use Viara to violate any law, to store information you don't have the right to store, to interfere with the app's operation, or to attempt to access another family's data without authorization.
7. Termination
You may delete your account at any time from Settings → Privacy. We may suspend or terminate accounts that violate these terms or applicable law.
8. Dispute resolution; arbitration agreement
Agreement to arbitrate. This section is governed by the Federal Arbitration Act. You and IndicWave LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Viara will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small claims court instead.
Class action waiver. You and IndicWave LLC each agree that any arbitration or other proceeding will be conducted only on an individual basis, not as a class, consolidated, or representative action. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) may proceed in court, and every other claim remains subject to arbitration.
Your right to opt out. You can opt out of this arbitration agreement entirely. To do so, email support@viara.io within 30 days of creating your account, stating your name and that you're opting out of arbitration. Opting out doesn't affect anything else in these Terms, and we won't treat you differently for opting out.
Exceptions. This section doesn't apply to claims for injunctive relief over misuse of the Service, intellectual property infringement, or wherever arbitration is prohibited by law.
9. Disclaimer of warranties; limitation of liability
Viara is provided "as is." To the maximum extent permitted by law, IndicWave LLC disclaims all warranties, and is not liable for indirect, incidental, or consequential damages arising from your use of the app. Nothing in these terms limits liability that cannot be limited under applicable law.
10. Changes
We may update these terms from time to time. Material changes will be communicated in-app before they take effect.
